MP High Court Upholds Divorce Over ‘Vulgar’ Chats Between Wife and Male Friends

In a recent ruling, the Madhya Pradesh High Court dismissed a woman’s petition challenging a family court’s decision granting her husband a divorce on the grounds of cruelty. The bench, comprising Justice Vivek Rusia and Justice Gajendra Singh, upheld the lower court’s verdict, stating that no husband would tolerate his wife engaging in “vulgar” conversations with male friends after marriage.

The case involved allegations from the husband that his wife had been discussing her sex life with her male friends via mobile chats after their marriage in 2018. The husband claimed these conversations were inappropriate and offensive. Despite the wife’s defense—denying the accusations and claiming her husband had hacked her phone to fabricate evidence—the court sided with the husband, noting that such behavior amounted to mental cruelty.

The court emphasized that while both spouses have the freedom to communicate with friends post-marriage, the nature of the conversation should remain respectful and dignified, particularly when interacting with members of the opposite sex. It stressed that such behavior would be considered objectionable to a life partner, especially when it involved inappropriate conversations.

In support of the husband’s claims, the woman’s father testified that she frequently engaged in conversations with male friends. The court also found that her denial of the claims lacked credibility. Consequently, the High Court upheld the lower court’s decision, affirming the divorce.

The woman had also raised allegations of dowry demands against her husband and accused him of violating her privacy. However, the court rejected these claims, reinforcing that the husband’s objections to the nature of his wife’s communications were legitimate grounds for divorce under the principles of mental cruelty.

This judgment underscores the importance of maintaining decency and respect in relationships, particularly in the context of digital communication.
