Allahabad HC Grants Bail to Rape Accused, Says Victim ‘Invited Trouble’

The Allahabad High Court recently granted bail to a man accused of raping a master’s student, citing that the victim had “invited trouble” upon herself. Here’s a detailed breakdown of the case:

The victim, a postgraduate student from a Noida-based university, met the accused at a bar in Delhi’s Hauz Khas area with her friends. After consuming alcohol, she became intoxicated, and the accused offered to accompany her home. She agreed, expecting him to take her to his Noida residence, but instead, he took her to a relative’s apartment in Gurgaon, where she alleged she was raped twice.

In her complaint, the victim stated that she was touched inappropriately by the accused on the way to Gurgaon and was raped twice at the relative’s apartment. However, during her medical examination, while her hymen was found torn, the doctor did not provide any opinion on the alleged sexual assault.

The accused argued that the incident might be a case of consensual sex, as the victim had agreed to accompany him to his place for rest. His counsel also highlighted that he had no prior criminal history and had been in jail since December 2024, promising to cooperate with the investigation if released on bail.

Justice Sanjay Kumar Singh granted bail, observing that the victim, as a postgraduate student, was competent enough to understand the “morality and significance” of her actions. The court noted that even if the allegations were true, the victim’s decision to accompany the accused after becoming intoxicated at a bar contributed to the situation.

This ruling has sparked controversy, with many questioning the court’s stance on victim responsibility in rape cases.
