The Union government has cautioned the Supreme Court against the "far-reaching socio-legal implications" of criminalising marital rape, urging the court to consider a broader social context rather than a strictly legal framework. In an affidavit submitted in response to petitions challenging the constitutionality of the marital rape exception, the Centre emphasized that this issue transcends constitutional concerns and is deeply rooted in social dynamics.
The government warned that criminalising marital rape could disrupt conjugal relationships and destabilise marriages, expressing concern about the potential misuse of amended provisions in today's rapidly evolving social landscape. The affidavit highlighted that Parliament had previously opted to retain the marital rape exception during the 2013 IPC amendments after careful consideration.
