Congress Moves High Court Over Cabinet Expansion

The petition challenges the recent expansion of Chief Minister Vishnu Deo Sai’s cabinet, which now includes 14 ministers — allegedly violating the constitutional cap.
What the Constitution Says About Ministerial Limits
According to Article 164(1A) of the Indian Constitution, a state’s cabinet size must not exceed 15% of the total legislative assembly strength. Chhattisgarh’s assembly has 90 members, which means the cabinet should include no more than 13 ministers, including the Chief Minister. However, after three new ministers took oath on August 20, the cabinet strength rose to 14, triggering legal action.
Opposition Demands Minister Removal
On August 22, Leader of Opposition Charan Das Mahant wrote to the Governor, urging the removal of one minister. He argued that the current count exceeds the constitutional threshold and must be corrected immediately. Bhupesh Baghel Questions Legality of Expansion
Former CM Bhupesh Baghel also criticized the move. He accused CM Vishnu Deo Sai and Governor Ramen Deka of bypassing constitutional procedures. Baghel recalled that in 2019, his government proposed raising the ministerial cap to 20% for larger states. However, the BJP and central government rejected the proposal. He demanded clarity on whether the current expansion received gazette notification or central approval.
Government Defends Cabinet Composition
Meanwhile, Deputy CM Arun Sao defended the decision. He claimed the government followed proper constitutional process and cited Haryana’s precedent, where a 90-member assembly accommodates 14 ministers. Sao criticized Congress for what he described as a history of constitutional manipulation.
