CJI Strong Warning Against Derogatory Language Towards Women: “No Place in Courtrooms”

In a significant address aimed at upholding the integrity of the judiciary, Chief Justice of India DY Chandrachud emphasized that all forms of derogatory language, particularly against women, have no place in courtrooms. This statement comes in response to multiple complaints from women judicial officers regarding the use of such language by certain members of the administrative establishment.

During the inauguration of the North Goa District Courts Complex, CJI Chandrachud underlined the importance of using language that reflects inclusivity, respect, and empowerment. He noted, “As we strive for inclusivity within our courtrooms, the language we use must reflect our ethos. We must be vigilant in our choice of words, ensuring that our language is not only precise but also respectful.”

The Chief Justice highlighted the detrimental impact of language that perpetuates stereotypes based on gender, caste, or socioeconomic status. He expressed concern over complaints from women judicial officers about derogatory remarks made by administrative personnel.

In addition to addressing language issues, CJI Chandrachud discussed the Supreme Court’s initiatives to enhance gender awareness and combat stereotypes. He mentioned the creation of a handbook on gender to guide courtroom discourse and emphasized the responsibility of judicial officers to elevate legal conversations and make judgments accessible in all regional languages.

Furthermore, the CJI called for a redesign of the statue of the Lady of Justice, stating that the law should not only be seen as blind but should recognize the diverse experiences and struggles of individuals entering the court.

Chandrachud concluded by affirming that true equality under the law goes beyond formal equality, acknowledging the substantive needs for security and understanding in the judicial process.
